Pois é, o Futebol é organizado pela FIFA...logo têm q cumprir com as regras da FIFA. Não é ditadura, são regras !

Não consigo perceber esta mentalidade! O Bosman também estava a quebrar regras, e em última análise venceu! Porque a lei geral é mais forte do que a lei do futebol!

É quase a mesma coisa que entrar numa loja onde está afixado que não trocam produtos em saldo. É uma regra ilegal!

Se está nas regras do jogo, não percebo o problema... Nem porquê essa história de o futebol estar acima da lei. Se eu aceito entrar num jogo, jogo segundo as regras. As simple as that.

Para que conste, a Juventus pensou em fazer o mesmo em Itália por causa do Calciocaos. Entretanto, não entrou nessa história - é que os clubes italianos ficavam todos de fora das competições europeias. Se o Gil continua assim, vai abaixo e vai mesmo.
Mas é que a instituições não percebem que as alternativas que estão a dar ao Gil são as de descer ou descer (ou porque desiste ou porque é obrigado). Assim, não tem nada a perder e pode arrastar o futebol português consigo.

A lei e direito não podem ser sobrepostos pelas regras do futebol


Tantos que lutaram para que hoje em dia pudessemos exercer os nossos direitos de cidadania, exigir os nossos direitos á justiça e igualdade e depois aparece uma qualquer instituição com fins comercias, - sim porque o futebol é dos maiores negócios conhecidos e a FIFA como o Excalibur colocou e como o Prof. Marcelo R. de Sousa bem disse é uma empresa - a sobrepôr-se ao direito comum.

Decidir sobre um caso de jogo, uma suspensão, um penalização sobre actos de indisciplinas , etc, etc. Isso é parte do jogo e sobre isso façam regras e apliquem os seus estatutos, mas impedir que recorram aos tribunais, ameaçando e penalizando, isso é errado e vai contra os mais elementares principio da igualdade e justiça.

A única coisa que concluo no meio disto tudo é que a fifa tem medo dos tribunais, o que tendo em conta a corrupção que por lá anda, não é de admirar.
Se o Gil ficar a meio caminho, pode ser que a Juventus, que não tem muito a perder, consiga levar o caso até ás ultimas consequências.

Se não for nenhum destes dois, alguém vai aparecer, os regulamentos da fifa e tudo mais, já mais conseguia ganhar um caso destes no tribunal europeu, existe uma gritante e aberrante discrepância entre as regras da fifa e das leis (e constituições ) de (alguns) estados-membros.

E depois, adeus Fifa tal como a conhecemos.

Se isto se passasse com outra multinacional ( ou mera empresa), que no seu contrato, ou regulamento que no contrato aceita-mos respeitar, tivesse clausula do género "recurso a tribunais civis dá-nos o direito de o despromover, retirar regalias, ou em caso extremo, despedimento por justa causa", queria ver se também achavam bem.

Sim porque a FIFA tem REGRAS, não leis e quem quer participar num campeonato profissional, tem de acatar essas regras, quem as infringe é penalizado

O jogador tinha um contrato profissional, transferiu-se para uma equipa distrital e ficou com um contrato amador ( Quem fez as regras as votou e aprovou foram os próprios clubes )

Foi sondado por outros clubes, pelo menos 2 da 1ª divisão, mas ao saberem que tinha um contrato amador, sabiam que tinha de decorrer 1 ano até poder jogar, não confundir com ser inscrito, simplesmente desistiram, pois não queriam ficar com um jogador que não poderia jogar, só treinar e participar em jogos particulares e ter que lhe pagar ordenado

Mas, não é que houve uns xico espertos que se chegaram á frente e neste momento estamos em sérios riscos das equipas portuguesas e a própria selecção serem excluidas do calendário europeu

Mas como neste País a culpa morre sempre solteira , depois pedimos responsabilidades a .................

Qual o problema de jogar um ano como amador e ter que esperar outro para jogar como profissional? Uma pessoa que se quer dedicar por inteiro ao futebol é obrigada a ter dois empregos? E parece que não sabes que foi o Vice-Presidente da FPF, Amândio de Carvalho, que aconselhou o Gil Vicente a ir a tribunal.
 
Eu quero ver se a Selecção A ou os 3 grandes forem "prejudicados" e consequentemente impedidos de jogar nas provas que frequentam, se ainda acham justo o que o Gil quer... :D

Era só para demonstrar que as regras alteram-se. Não se pode justificar com o facto de clubes não fazerem isto ou aquilo por causa das regras serem de certa maneira, pois são regras que podem não estar correctas.

E já agora, tal como a liberdade de movimentação de cidadãos é consagrada na UE, o poder dos tribunais não é consagrado por exemplo pela constituição portuguesa? São um dos 4 orgãos de soberania!

Não sou advogado, mas aí acho cabe a um Tribunal decidir sobre uma eventual nulidade de algumas regras, caso contrario são totalmente legitimas.
 
O problema é que os estado sobreanos foram deixando que a FIFA e UEFA detivessem poderes "legais", porque assim os seus sistemas judiciais não se sobrecarregavam com problemas legais mas do foro desportivo.

Agora o monstro está gordo, forte e anafado e todos têm medo de o defrontar.

se os clubes e jogadores em causa tivessem sido obrigados a assinar o compromisso, mesmo nao concordando com o que nele consta, enfim, teriam razao! É CRIME! seja para jogadores, clubes, ou para qqr um de nós.

quando nao concordo com o que está escrito, simplesmente NAO ASSINO! dependendo do meu interesse na coisa, luto ou nao pela MUDANÇA do que está escrito.

A FIFA e as politicas aplicadas pela mesma começam a ter contestação, o que demonstra que gradualmente se comaça a abrir os olhos para situações que são caricatas e muito dubias.

The European Court of Justice is set to rule on whether the FIFA rules on compulsory release of players for international matches comply with the EU legislation on competition and free movement of workers.
Background:

The Royal Sporting Charleroi F.C and G-14, the group of Europe's 18 most powerful football clubs, filed a case against the International Football Federation (FIFA) before the Charleroi Commercial Court (Belgium) on 20 March 2006.

The clubs accuse football's world ruling body of "unlawful use of club players in national teams". The Belgian club Royal Sporting Charleroi F.C filed the case after one of its players, Abdelmajid Oulmers, was hurt playing on national duty for Morocco in 2004. G-14 and Royal Charleroi want the current FIFA rules on the compulsory release of players for international matches judged illegal or amended through a dialogue with the clubs.

The G-14 is also asking for 860 million euro in damages from FIFA for the costs incurred, over the past ten years, of putting players at FIFA's disposal to play in national teams and their subsequent unavailability if they suffer injury.

The last major football case in the European Court of Justice, the 'Bosman ruling' in 1995, gave professional football clubs' players the right to a free transfer at the end of their contracts.
Issues:

The Belgian Commercial Court of Charleroi decided, on 15 May 2006, to reject the G-14 demand, on behalf of its members, for 860 million euros in damages from FIFA.

As to the question of the fundamental legality of FIFA's rule on releasing players, the Charleroi Court decided to refer the case to the European Court of Justice (ECJ) for a decision as, according to the judgement, existing jurisprudence is not applicable to the case and a new interpretation is of general interest for the uniform application of the Community law through the EU.

The ECJ is thus now set to rule on whether the FIFA Regulations for the Status and Transfer of Players complies with the Treaty of Rome, specifically article 39 (Free movement of workers) and article 49 (Free movement of services) and whether the FIFA rules governing player release and insurance are an abuse of dominant position under articles 81 and 82 (Rules on competition) of the EU Treaty.

The decision to refer the case to ECJ was requested by G-14 and Royal Sporting Charleroi F.C as part of their legal submissions, where they claim the FIFA statutes governing player release and insurance are an abuse of dominant position under articles 81 and 82 of the Treaty of Rome. It thus wants the current FIFA rules on the compulsory release of players for international matches judged illegal or amended through a dialogue with the clubs.

The fact that the case is now referred to the ECJ might relaunch negotiations and dialogue between the G-14 clubs and FIFA.
Positions:

FIFA expressed satisfaction with the Charleroi court's decision to reject the G-14's claim [for the 860 million euro] compensation made on behalf of its members. In its previous statements, FIFA has said that it "expects the legal dispute to be protracted, especially if the EU' legal bodies are drawn into considering the regulation regarding the release of players". FIFA says that UEFA, four other confederations and 48 European associations support it.

G-14 statement says that it "has long campaigned for the rights of clubs to be more fully recognized at an international level. G-14 believes the existing structure, which prohibits clubs from any direct representation in the decision making process, even on issues where clubs are directly affected, is out of date and unfair".

"Excluding the clubs from the decision making process when their interests are at stake is not only wrong politically, it is also legally an abuse of dominant position. Now, this fundamental issue will be judged by the European Court of Justice," said G-14's lead counsel, Jean-Louis Dupont.

National football associations affiliated to FIFA tend to take FIFA's stand on the issue as it supports the associations financially and logistically through various programs and grants them a number of rights and privileges. If FIFA needed to pay the big clubs compensations, the grass root organisations would suffer from reduced financing.
Latest & next steps:

* The Commercial Court of Charleroi now needs to write and send an order of reference to the ECJ. Depending on cases, this procedure can sometimes take months.
* Once a case arrives to the ECJ, the average time to work on it is around 20 months (unless the case is decided urgent and dealt with accelerated procedure). The ECJ is thus not expected rule on this football case before spring 2008.

Greek Deputy Sports Minister George Orfanos felt the heat this summer when FIFA excluded Greek football teams from international competitions. FIFA was unhappy with proposals for a new law which would open the Hellenic Football Federation to public scrutiny. In the end, football was exempted from the law leaving Orfanos to ask whether FIFA is above national lawmakers.



“The international sports federations, due to the great publicity and commercialism acquired by sport, are now in a position to shape legal relations and situations which are alien to the competitive part of the sport they are promoting”, Orfanos said at a meeting of EU sports ministers back in May.



Orfanos was keen to get the backing of his European colleagues in clarifying the legal relation between international sports federations and laws passed by member states and the EU – particularly in view of the ongoing dispute between FIFA and the Greek government.


Exclusion used as lever to exempt football federation from new law

Over the summer, it became clear that Orfanos was right when he said that organisations like FIFA are in a position to shape legal relations.



According to World Sports Law Report, FIFA has intervened in Greek lawmaking on sport on three separate occasions since 2001. In all instances, laws were proposed which would allow the state some influence in the administrative matters of football including elections in the Hellenic Football Federation.



World Sports Law Report explains that the proposals discussed this summer would mean that changes to the statutes, the composition, the structure, the operation and economic administration of committees of the Professional Football Association should be approved by the Secretary of Culture after legal scrutiny.

Such proposals are incompatible with FIFA Statutes which say that in order to participate in international football, national football federations must be independent from any influence from governments. And in spite of ongoing negotiations with the Greek government, FIFA decided to up the ante by suspending Greek football – a move that created headlines all over the world and an immense pressure on Greek politicians.

A few days later, the Greek Parliament passed the new sports law with a special provision for the Hellenic Football Federation which specify that all matters of operation and organisation of football are regulated autonomously by the HFF and therefore HFF is not subject to the new law. FIFA immediately readmitted Greek football teams to international stadiums and tournaments.


Greeks have lost faith in football authorities

So FIFA and HFF are happy. But does that mean that all is well in Greek football?

Reflecting on events, Deputy Sports Minister George Orfanos described the new law as pioneering and aimed at improving governance and transparency in professional sports in general and football in particular so that the Greeks can regain their trust in Greek football.

That trust has hit an all-time low. According to a Greek webservice, Phantis.com, a survey released this week by the Pulse Research and Consulting Firm and conducted by the Athens University of Economics showed that only 8.5 per cent of 1,500 Greeks surveyed believe that Greek professional football is clean. 47 per cent surveyed said they did not trust football authorities in the country.

Interviewed by EurActiv.com Borja García, a researcher at the Department of Politics, International Relations and European Studies at the Loughborough University in the UK, explains his view on the priorities for the reform of the European football. He also gives his guess on the result of the Oulmers/Charleroi case and his expectations for the Commission's white paper on sports.

In your recent policy brief on EU regulation of professional football since the Bosman ruling you write that the EU has two approaches towards football: a legal and a political one. What do you mean?

The EU has been involved in the regulation of sports mainly as a result of the increasing commercialisation of professional sport over the past 20 years. This has led to treating sport as any other economic activity, therefore applying the laws governing the single European market. This is a legal approach, because the debate was on whether EU law could be applied to professional sport, not on how to do that. The answer to this debate was clearly provided by the European Court of Justice (ECJ) in 1974 and other subsequent rulings: Yes, EC law shall be applied to sport as an economic activity; hence creating another spill-over from the single market.

However, after this question was settled, the debate moved on to how EC law shall be applied to sport. This is the political approach to sport, because the regulatory debate has been politicised. This is nothing unusual, as most regulatory policies tend to get politicised over time. This political approach does not rely only on legal technicalities, but on political arguments about the role of sport in society and the necessity to preserve it as something 'specific' or 'special'. As time has gone, the political debate has permeated the legal approach and, nowadays, the political approach has the upper hand. This can, however, change very quickly, for example with the ECJ ruling on the Oulmers case.

The Independent European Football Reviewcalls for major reform of the European football. Where should one start from? What should be prioritised?

First of all, it is necessary that all stakeholders involved in the governance of football have an understanding of the problems they are facing. It is paramount that they understand that the Bosman ruling is not the cause of European football's problems.

It may have been an accelerator of some worrying tendencies, but it is not the cause. It is the massive commercialisation and enormous influx of money from TV rights that is at the root of the problems, for it is causing both corruption scandals (see Italy, Germany, Belgium...) and an internal fight for power in the governance of football.

Therefore, priority number one should be to ensure that football governing bodies operate to the highest standards of governance. For that, representation, democracy and transparency need to be enhanced at all levels. It is not fair to single out a particular stakeholder, as they all need to improve. Certainly, some organisations, such as UEFA or the English FA are way ahead of the others since they have been focusing on good governance for some years. They could lead the others towards an improvement on the governance of football, because without that, it will not be possible to let football self-regulate without interference of public authorities.

A second priority should be legal certainty. In exchange of a genuine effort to improve governance and management, football should get a good degree of legal certainty. This means that the rules agreed commonly by the football family, e.g. collective selling of TV rights, are not in danger of being challenged before the courts. In this respect, it would also be useful if the European Commission could manage to adopt a common view towards football among its own different DGs. However, it should be noticed that this legal certainty has to be preceded by a real commitment of the football family to improve its levels of governance. It is not the other way around.

Should football be exempted from EU competition rules? Arguments for and against?

The answer to this question, from my point of view, is relatively short. No, I do not think football should be exempted from EU competition rules because professional football is an economic activity with high levels of turnout and, moreover, the impact of professional football on other markets, such as the TV market is extremely important. As long as football is willing to operate as a business, it has to be prepared to be treated as such. Having said that, I agree that the economics of professional football have some specificities. For example, in football there is a need for a rival. Whereas Opel may be happy if Renault disappears, Manchester United needs Liverpool to maintain the competition, or Barcelona needs Real Madrid.

The ECJ, in Bosman ruling, recognised two aspects of the specificity of football: the uncertainty of competition and the training of young athletes. I think there are some others, but this is just to show that the EU is aware of the specific nature of sport. Therefore, the application of competition policy needs to be tailored to the characteristics of football as a market. For example, allowing collective selling of TV rights, something that the Commission is happy to accept since the Champions League Case in 2001.

How do you think the Oulmers/Charleroi case will affect football in the EU?

The Oulmers case has the power to undermine the 'political' approach of the EU towards football in favour, again, of the legal approach. A ruling favourable to the clubs will highlight the dominant position of governing bodies towards the clubs. This may translate in a redistribution of power in the governance of the professional game at European level. It has to be said that clubs have already the power to organise their competition through associations such as the Premier League or Lega Calcio. Oulmers could enhance the power of clubs vis-à-vis UEFA and FIFA. Another consequence would be the diversion of money to the clubs.

FIFA and UEFA manage the economic benefits of the World Cup and the Euro. In the case of UEFA, the EURO is the main source of funding for its solidarity programs, therefore if money has to be given back to the clubs, solidarity programs will suffer. Having said that, my personal opinion is that the ECJ is not going to rule in favour of the clubs. Oulmers is not going to be a Bosman 2 and I think that the G-14 is pursuing the wrong strategy here.

What role and impact do you think the Commission's upcoming white paper on sports will have? What would you like to be taken into account in it?

It is difficult to say until we see the content of the white paper. The white paper is mainly addressed at the political level, since the EU has no direct competence on sport. The intention, as I see it, is to have a political debate within the college of commissioners on the role of sport in the EU and in European society.

The ultimate goal, of course, would be the mainstreaming of sport into other active policies of the EU, such as health (fight against obesity), social policy (fight against racism) and so on. In that, I share UEFA's view that sport (and football) is probably one of the best tools at the disposal of EU policy-makers to achieve certain policy goals. Politicians need to realise that and to engage in a partnership with sports authorities for the good of the game and for the benefit of the whole society.

The problem is that a similar document to the whitepaper, the so-called Helsinki Report on Sport, was adopted in 1999 and it is now gathering dust, nobody seems to remember that report is an official position of the Commission. I hope the white paper has a better future.

As to what should be taken into account, I think it is paramount that, first of all, we get a clear definition of sport and its multiple dimensions. It is really incredible that after so many years of policy debate there is no single EU document with a definition of what sport is.

Yes, there is the European Model of Sport, but this is not a definition, this is a description. So far, the only official definition of sport can be found at the Council of Europe's 1992 European Sports Charter. The white paper needs to come with a definition in which it identifies the different dimensions of sport. Professional sport is very different from amateur sport - they have totally different dynamics. When the EU talks about sport, to which dimension it is referring? How different should the policy be towards professional sport and amateur sport? It will be very difficult to formulate a coherent policy until this is clarified.

Secondly, I think that the importance of sport as a tool for public policy needs to be taken into account and the role that governing bodies can play in that. Finally, I think that there is a need to provide standards for good governance in sport.

What impact will, if adopted, the future European Constitution have on sports in the EU?

The Constitution proposed a very low level of competencies on sport for the EU. It was just a supporting role, so sport would remain a national competence. Of course, the inclusion of sport would make it easier for the commission to work on sport, as it would then have a legal base.

The success of the 2004 European Year of Education through Sport demonstrates that there are many possibilities to engage the citizens into sport, which is a good thing. The main consequence would be that the European sports ministers could now meet officially, and they could implement their agenda focused mainly on amateur sport, volunteerism and the fight against doping. Sports authorities could co-operate to a better standard to improve the governance of sport in Europe, both at professional and 'sport for all' level.

Eu acho engraçado alguns critérios.
Apregoam a lei, a justiça etc, etc. Mas depois aceitam que as regras de um Organismo que regula um Jogo se sobreponha ás leis de um pais ou de uma Comunidade Internacional.
